Processing of personal data from road accidents

Any person involved in a road traffic accident is informed that personal data concerning him or her is being processed in accordance with the General Data Protection Regulation (GDPR).

These processings are necessary for the performance of the general interest mission of the French Road Safety Observatory (ONISR), in that they contribute to the preparation, implementation and evaluation of road safety policy, and pursues statistical purposes relating to physical road traffic accidents.

The following information is intended for all persons involved in a traffic accident.

Processing of personal data relating to traffic accident analysis bulletins for road safety statistics

In accordance with the law 78-17 of January 6, 1978 on Data Processing, Data Files and Individual Liberties, as amended, and the General Data Protection Regulation (GDPR), the Controller, the Interministerial Director for Road Safety, implements the ‘Traffic Accident Analyses Bulletins (known as BAAC file)’ processing, which aims to establish road safety statistics, analyze accidentality and evaluate road safety policy.

The legal basis for this processing is the ONISR's general interest mission. It collects from the BAAC the following categories of data: civil status, socio-professional category and postal address of the driver, traffic offences, health data, an authentication key shared with other information systems, driving license number and information on the driving license, vehicle registration number and information on the vehicle involved (including regularity of insurance), civil status and postal address of the owner of the vehicle involved, as well as the factors and circumstances of the accident.

This data is kept for an indefinite period due to the general interest mission of the ONISR "responsible for the information system relating to road accidents and offences, for the collection and dissemination of information necessary for the preparation, implementation and evaluation of road safety policy" (Decree no. 2013-728 of August 12, 2013 organizing the central administration of the Home Office).

The recipients of this data are the organizations in charge of the ONISR information system, the national file of road accidents recorded by police forces (BAAC file), police forces and public employees of the ONISR and departmental and regional road safety observatories.

Personal data can be accessed by the organizations in charge of the BAAC file, law enforcement agencies, public officials with road safety missions, technical and scientific organizations and authorized persons insofar as their mission is to improve road safety knowledge or consolidate accident statistics, as well as anyone consulting the OpenData platform, for which personal data is reduced (more information here on data available on the government OpenData website).

The rights to erasure, to restriction of processing and to object do not apply to this processing, which is necessary for the performance of a mission of public interest.

This processing is supervised by the Ministerial Delegate for Data Protection of the Home Office (Délégué ministériel à la protection des données - ministère de l'intérieur - place Beauvau - 75 800 Paris cedex 08). Processing of personal data relating to traffic accident official reports for road safety statistics

In accordance with the law 78-17 of January 6, 1978 on Data Processing, Data Files and Individual Liberties, as amended, and the General Data Protection Regulation (GDPR), the Controller, the Interministerial Director for Road Safety, implements the ‘Recording and consultation of road accident official reports recorded by police forces’ processing, which aims to consolidate road safety statistics, analyze accident rates and evaluate road safety policy.

The legal basis for this processing is ONISR's general interest mission. This processing collects the following categories of data: civil status, socio-professional category and postal address of drivers, registration number in the national register for the identification of natural persons, traffic offences, health data, information on the driver's driving license and the vehicle involved (including the regularity of insurance), as well as the factors and circumstances of the accident.

This data is kept for a maximum of 11 years from the date it is recorded in the BAAC file.

The recipients of this data are the public agents of the ONISR and the departmental and regional road safety observatories, who are also the ones that can access the data.
